Thank you for choosing to join us. These terms govern the conditions of membership and participation in Studio Naim's activities.

Recurring Payment (Standing Order)

Membership payment is made automatically, through a monthly charge to a credit card only. The member consents to collection by standing order as a condition of purchasing the membership, thereby authorizing the company to charge their credit card for the membership fees and any other amount the member owes the company.

Debt Collection Authorization

The member grants the studio an irrevocable authorization to charge the payment method they provided in order to collect any amount owed to the studio, including membership fees, the one-month notice period, additional purchases and any other debt. A returned charge (credit card, debit or standing order) will incur a returned-payment fee accordingly, and the member is responsible for ensuring sufficient funds on the charge date.

Trial Period for New Members

To let you try out the studio, new members (those who have not previously been at the studio) may stop their membership at the end of the first month by filling out a cancellation form, with no need to give 30 days' advance notice.

Cancelling a Membership

The membership renews monthly with no fixed-term commitment. You may stop your membership at any time by sending a cancellation notice through the dedicated form on the studio's website. We ask for one month's advance notice of cancellation (during this month you may continue to come to the studio). Cancellation is carried out in accordance with the Consumer Protection Law (Amendment No. 37), 5774-2014, and the Consumer Protection Regulations (Cancellation of a Transaction), 5771-2010.

Punch Card or Fixed-Term Membership

Payment is collected in advance. The punch card is limited in time and in the number of entries, and cannot be cancelled during its term. A fixed-term membership involves a registration fee.

Membership Terms

Membership terms vary according to the type of membership, as published on the website at the time of registration. The studio may change the membership terms and raise the membership fees, provided that advance notice of at least ten days is given before the charge is made.

Registration Fee

Studio Naim reserves the right to change the amount of the registration fee from time to time. A customer returning after a break of less than two months may be asked to pay a registration fee of ₪100.

Entry Identification

Entry to the studio is made using an entry identifier. Studio Naim reserves the right to charge a deposit for this identifier.

Personal Membership

Membership at the studio is personal and non-transferable, and entry is permitted using the personal identification means only. A member caught entering without identification, or who admits a non-member without authorization, will be charged a fine equal to a single entry (together with the person admitted), and the studio may cancel their membership.

Freezing a Membership

You may freeze your membership once a year for one week at no cost. Each additional freeze costs ₪25 per two weeks (for example, a one-month freeze costs ₪50). Exceptions: a medical condition (with a doctor's note) or reserve military duty (upon presentation of an order), in which cases the membership may be frozen at no cost and also retroactively. Even in these cases, a membership cannot be frozen for less than a week, and a membership cannot be frozen and reactivated intermittently (the membership must be active for at least two months between one freeze and the next). A membership may not be frozen more than three times a year.

Freezes must be requested through a dedicated form on the website.

Medical Condition

Training in the gym is conditional on completing a medical questionnaire and signing a health declaration, or providing a suitable medical certificate, as relevant and in accordance with the law. Full responsibility for providing the medical certificate rests with the member and is at their own expense. In the absence of a health declaration or a suitable medical certificate, the member will not be permitted to train in the gym.

Members suffering from medical conditions, including diabetes, heart disease, high or low blood pressure, or who use medications (including anticoagulants, antihistamines and beta blockers), must consult a doctor before using the gym equipment and the studio's classes. In any case of a claim of injury at the club, the member must complete an incident report and notify the club management immediately.

By using the membership, you declare that you understand that any physical activity carries a risk of physical or mental injury, and that it is your responsibility to assess your physical and mental abilities for such activities.

Classes

Do not enter classes without prior approval from the reception, and do not be late for classes. If you are late, entry will be permitted subject to the conditions of the specific class and at the discretion of the reception and the teacher. In any case, entry will not be allowed once ten minutes late or more. The procedures for registering for and cancelling classes through the app are detailed on the class rules page. Opening and running a class depend on a minimum number of participants. The studio may stop or change activity times and replace teachers and instructors, at its discretion.

Minimum Age

Entry to the studio and the gym is for ages 18 and over.

Gym

Members must wear suitable shoes, dress in proper sportswear and use a towel on the gym equipment. Please take care of the equipment, return it to its place, treat those around you courteously and avoid noise that may disturb them.

Guidance and Responsibility in the Gym

The member must receive initial guidance from the studio team on how to use the equipment and facilities before using them, and no facility may be used without such guidance. During some operating hours an instructor will not be present in the gym, in accordance with the Fitness Centers Law (Licensing and Supervision), and use of the facilities during those hours is the trainee's sole responsibility.

Safety and Conduct Rules

It is strictly prohibited to enter the studio with a weapon of any kind; to smoke (including e-cigarettes) on the studio premises; to enter or train under the influence of alcohol, drugs or sedatives; to bring in animals; or to bring in alcoholic beverages and vessels or containers made of glass or other breakable material.

Photography

Trainees may film themselves during their workout, provided the footage does not include other trainees without their explicit consent. Any material filmed or recorded in the gym that includes other trainees without their consent must not be distributed, shared or published on any platform whatsoever.

Belongings and Property

The studio is not responsible for items left by the member on the club premises, whether stored in a locker or not. Do not leave equipment behind after leaving the club. At the end of operating hours, the studio may clear the contents of locked lockers.

Force Majeure

If the studio is closed or its activity is restricted due to circumstances beyond its control, such as the outbreak of an epidemic (e.g. coronavirus), a governmental or administrative order, war, reserve-duty call-up or a large-scale military operation, natural disasters or any other public emergency that prevents holding the activity or using the facilities ("force majeure"), the member will be entitled to a freeze of the membership period corresponding to the period of prevention only, and will not be entitled to any other compensation or indemnity. Where only part of the activity can be maintained, the studio will operate within the possible limitations and the member will not be entitled to compensation for this. In any event, the standard cancellation terms set out in these terms and in law shall apply.

General

The studio may terminate a member's membership in the event of a breach of any provision of these terms or of any instruction from the club staff, or in the event of a serious breach of discipline, rude, unruly or violent behavior, or rude or violent verbal expression.

The studio reserves the right, at its sole discretion, to refuse to accept an applicant as a member or to renew an existing membership.

All activities at the club (including showering) must be completed and the member must leave before the closing time set for each club.

A membership purchased from any third party cannot be redeemed at the clubs, except after six months from the end date of the existing membership.

Changes to the Terms and Company Details

The company Normal Mehkar Ltd. (company no. 513744896) may change and amend these terms from time to time at its discretion. The updated version is published on the studio's website. Privacy and Personal Data

Use of the studio's services and the submission of personal data constitute consent to the collection and processing of the data in accordance with the studio's privacy policy, set out in full on the Privacy Policy page.

Governing Law and Jurisdiction

These terms shall be governed solely by the laws of the State of Israel, and exclusive jurisdiction over any dispute arising from them shall lie with the competent courts of the Tel Aviv-Jaffa district.

Acknowledgment and Consent

The member declares that they have read and understood these terms, that they constitute a binding contract between the member and the studio, that they have received answers to all their questions and an explanation of their right to cancel the membership, the manner of cancellation and the costs involved, and that their signature (including electronic) on the registration form and on these terms constitutes consent to its contents.
